動機很簡單就是不爽BSN
不然怎會閒閒沒事去找碴
TO:Ian兄 您放心 是不會傷身體的
事情的原由就是 他們宣稱他們有一項肌酸叫做CEM3(獨家專利成份)
宣稱比市面上任何肌酸產品都好
如果大家手上有BSN的產品可以看一下背後成份
應該會看到CEM3 後面有一個小小的TM就是獨家專利的意思
但是 事實上他們這一項專利根本沒有申請過 但是還是把他印上TM 在所有的廣告上面宣傳
於是有人不爽 拿去檢驗發現所謂的CEM3到最後盡然只是純機酸 所以一狀告上去了
我想以買CELL MASS的最吃虧 至於NOXPLODE and NITRIX的倒是還好 畢盡那裡面本來就不會有太多肌酸成分 今天我比較訝異的是以一個這麼大的公司盡然搞出這一種飛機 真的該檢討
說真的他有些東西不錯這大家都知道 一個品牌的建立是靠很多好產品累積而成的
一個品牌的失敗也有可能就是一次商場上的欺騙所導致
相信這依次算是給BSN一個省思的機會
有點像大衛王和巨人哥利亞的故事

天哪，連米國都有黑心商品了，我還有兩罐Cell Mass沒開勒。
至於質疑動機的實在很奇怪，事實不是比較重要嗎？
就算是同業告發的，難道因此就可以說"不實廣告或宣傳"是可以做的？
我實在很想扯到政治，但是這樣對鐵大不敬，所以算了 ＞＿＜

有關於這個case 我已經看完整個pdf 了解了始末 謝謝你的詳細解釋
在我經過Ken的介紹 開始使用BSN 就看了他所謂CEM3的宣傳 感覺還蠻酷的
至於效果是什麼 我不太確定 我沒辦法知道 真正拿了肌酸之後的差別 真正在哪裡
以我的觀點來說 BSN的產品絕對有一定的品質 可是 欺騙大眾 實在不應該 賺太多了 哈哈
正如你所說的 這是他們的省思 會不會降價呢 哈哈 這是我比較關心的
不過 回台灣以後 需要你的知識 來嘗試你的獨門秘方 (so excited...)
btw, 我才剛從bb.com買了 2.1lb Cellmass + 2.7lb NOXplode 真是殘念 哈哈
and, 我今天不小心扭傷腳踝 超嚴重的 可是還是練完1個半小時才走 現在血管已經爆炸了 Orz

The Law Firm of Call, Jensen & Ferrell (“The Firm”), which is linked to BSN’s competitor(s) (which will all be disclosed at the appropriate legal time), filed a lawsuit against BSN on behalf of Michael Rivera and Dan Abell individually and on behalf of all other similarly situated (the “Lawsuit”). The Lawsuit alleges that: 1) CEM3 does not exist in CELLMASS®, N.O.-XPLODE™ or NITRIX®; 2) BSN’s patent pending for CEM3 does not exist; 3) CEM3 does not exist; and 4) BSN is the alter ego of Chris Ferguson.
BSN contends that all of the claims made against it and Chris Ferguson is meritless and intends to vigorously defend itself against these allegations. The Lawsuit is based upon a single test which did not directly test for the presence of the CEM3 ingredient, by a laboratory that never contacted BSN for information about CEM3. Contrary to the speculation of Call Jensen’s lawyers, a patent application for CEM3 does indeed exist and is currently pending before the United States Patent and Trademark Office. BSN is not the alter ego of Mr. Ferguson or any of its officers, but is a Delaware corporation in good standing and which observes all required corporate formalities.

整篇聲明稿的重點在於
這已經不是BSN第一次因為CEM3的原因被同業競爭者提出訴訟
而且訴訟的結果都是BSN勝訴
原因在於原告所提出的檢驗報告，根本不是針對「CELLMASS有沒有CEM3」
由於證據薄弱，採用焦點已經完全模糊的證據對美國BSN提出訴訟
換言之，等同於用誣告去攻擊已經成為眾矢之的的領導品牌BSN
因此這種接近於毀謗的訴訟，美國BSN公司也已經不曉得打過幾次這樣的官司
不過基於消費者的疑慮
本公司暫且不理會總公司的任何聲明
一切靜待美國司法的判決
但是在判決出來之前
我們將暫停問題商品CELLMASS的販售
雖然在Bodybuilding.com等等的論壇
都有強調說CELLMASS確實有很好的功效
但是基於商譽、消費者的權益
我們在第一時間也取消了CELLMASS的訂單
除非此次的判決確定CELLMASS完全沒有問題日後才會恢復販售

大意是說BSN覺得對於CEM3的測試並不公平 只用單一的測試方法 而且不是針對CEM3所做的測試
他們也反駁為啥麼測試之前沒有聯絡BSN取的CEM3的成分組成第二點 對於專利的申請案子的確存在,但是目前還在等待美國專利局的核定

所以整件事是羅生門 不過我比較好奇的是
1.是否可以用反證法來做測試 比如說想證明 X不等於2 事實上可以證明 X=3
這可以解釋為什麼原告不用得知CEM3的原料及可測試(沒跟BSN連絡)
2.如果他的專利現在還在等待美國專利局的核定 那就是事實上目前沒有專利了
a patent "application" for CEM3 does indeed exist 他是用application 不是用Trademark

我的想法跟你非常接近 尤其是Patent的部份 用application這個字 真的有些模糊焦點
不過 尚未水落石出 我們就還是靜待司法調查

開玩笑不要介意
其實就是無風不起浪 加上商場競爭激烈才會有這件事吧
不管結果判決如何 我想對於BSN都是很大的打擊
就像IAN說的雖然不是CEM3但至少還是純肌酸 至少不傷身體
以一個公司信譽方面來說 消費者對於BSN的信賴感一定會降低

其實類似的事件
也曾發生在BB.com的自有品牌上
同樣是宣稱CEE裡面卻是純肌酸
只是厲害的美國人知道 CEE有很酸的味道
所以沒多久就發現了
也因此BB.com特地道歉 並表示是上游廠商的問題......
並保證現在的CEE品質 並於網頁上付上檢驗報告

真的是滿無言的.這樣的大品牌卻搞這種飛機.還好我買的cellmass只剩一點點.我必須承認這事件也會此我對bsn其他產品有同樣疑慮.
david:那篇檢驗報告的內容是說宣稱每份有3000毫克檢驗出來卻只有1390毫克的意思嗎?

說真的，不管是怎樣都會對產品懷疑都很正常
日本也都陸續出現黑心商品，例如過期巧克力跟過期關東煮
但是換個角度想，以後出的Cellmass應該就會比現在好才對
不過我們在這邊討論也沒用，萬一到時候判決出來的結果並非我們在這裡說的那樣
那也是蠻糗的事情，不要法院還沒宣判我們就先判人家死刑
不過我個人看到台灣總代理的態度是很肯定的
第一時間就做出最果斷的決策，寧願把熱賣的商品停賣跟顧客站一起
無論如何他們也是受害者，我想對bsn的批評難免，落水下石的評論也逃不掉
他們該負責的就要負責到底
也給台灣的總代理商一點掌聲吧，很多大型的代理商公司遇到這種事情還會跟總公司「對抗」
我想是非常不簡單的，雖然我家還有一罐GRAPE COOLER還沒開，但是我還是選擇吃完
至少我們幾個朋友吃了的感覺確實不差
希望這家耀宗以後還是可以幫我們代理好的東西進來，這件事情，說穿了他們其實也沒有錯
十分欣賞他們負責到底的精神跟跟總公司對槓的GUTS
以後他們有代理我還是會選擇跟他們購買，畢竟人家也是很優先挺他們的顧客
Cellmass的話，等判決出來沒有問題再買吧~~
